Non EU mom married to alcoholic Swiss

Hi Everyone,

I'm a newbie here looking for some advice on my current situation.

My Swiss hubby and I have been married for 8 years and are blessed with 2 beautifully daughters age 6 and 1.
Since we met at school here in Switzerland long time ago, I used to have a student B permit. Was here from January 1996 until June 1999. (3.5 years).

Since then we were living in the US and moved back here in 2011. As for now I am still with a yearly B permit.
My husband has become an alcoholic and very emotionally abusive. He even almost hit me in front of our 6 year old daughter yesterday night while he was drunk. He even called me really bad names even though he knew my father who is here in vacation was still wide awake in the next room.

So now my father has asked me to take preventative actions. I would love a divorce since then I don't have to deal with him coming home drunk every single night and being verbally abusive to me and my daughter. However he does not want a divorce.
On top of that I am very worried that I can lose custody of my children since I am only on B permit.

I have been a housewife since we got married so yes my fulltime career is with my kids and managing the household:)

What I would like to find out are the followings:
1. If I call the cops when he's being physically abusive, will I be able to press charge on him and keep him in a mental hospital?

2. I am thinking of obtaining a Swiss passport ONLY for my kids. I would like to stay here and take care of them. I recall that I need to reside here for 5 years before being able to apply one. Since I have been here before as a student, would those years count?


3. I really feel stuck now. Anyone knows any organization in Basel that can provide me information on this matter?
